Question for Foks asking for a separate bill : I understand from Admins answer above , this may not be possible now.

My question is , separting this from CIR will QUICKEN the proceedings with respect to our issues?

Question for Admin : Was this poll started by IV?

BTW I have voted in favor of a separate bill assuming it will quicken things. Thanks.

This poll was started by one our forum members and not by the organizing committee.

Repeating my answer, no Senator is even willing to talk to us regarding an alternate bill till the fate of CIR is sealed.

Look at the necessary steps to pass a bill. We need to convince a senator, have the bill analyzed and discussed in the Senate Judiciary Committe, discussed and amended in the Senate Floor, passed in the Senate, convince a bunch of House Reps, get it introduced in the House, discussed in the House Judiciary Committee, discussed in the House, passed in the house. Only after all these steps will it be at the current stage as CIR.

So which Senator do you think will be willing to do all of this and then find that CIR with most of the provisions has already been passed.

When posts related to 'which airlines is good to fly' can be posted and reviewed under this section, why cannot this be posted too.

But if admin feels that its an irrelevant post, then please go ahead and remove it.

Dude, you revived a 6 month old thread just to ask this innocuous question? And the title of this thread is pretty alarming.

Expect 5 thousand red dots now. Everybody will come down on you like a ton of bricks.

    To admins..

we should have some facility to automatically close the threads that have been inactive for a while.

    Guys,
I have a long layover at New Delhi airport. I am reaching their at 8PM and my next flight in the morning at 7:30AM. Is there any accommodation facility within airport? Or Do i need to go to city? This is the first time, i am going through delhi airport. Any helpful comments are welcome. Thanks and appreciate your help.

Not sure if this is for us legal immigrants or against us. It says "hardworking americans". We are not americans yet. It could well mean that join the fight AGAINST H1Bs..

lazycis, jhaalaa, meridiani - Thanks for your inputs...you guys rock.

I believe Jhaalaa trying to caution me not to take chances and move to another employer, which could potentially cause RFE to my case. If so, thanks for you concern.

Meridiani thanks for the doc. I will read through it.

One more question, when I first filed my LC, I made x dollars, then I got a promotion and now making x+10K. When I move to a new employer, should I make x dollars? or x+10K? or is it okay to make x-10K?

They would however have to disclose that period of out of stay when they file the GC as G325 A asks for all status history. In other words, you will get screwed.

Whoever has some approval by means of luck or fluke does not make it the law. They will take the bite when time comes.

    Exactly.....You nailed it correctly.

    1. My lawyer clearly said you can't, unless you file it together with AOS.
    2. I765 and I131 forms. Everything else has already gone in with the AOS.

I spoke with the USICS immi officer...she mentioned that you cant apply Ead/ap without A#..they will rject it and you cant update them later with the #

You can work on h1b - you will get H1b based on existing approved 140 and pending 485.

If 140 is revoked by employer you may get a RFE or NOID or in rare cases erroneous denial but you can continue on h1b while you respond to RFE or NOID oor through MTR to erroneous denial.

Sending AC21 docs does not necessarily mean you may not get NOID - AC21 docs seldom go into your file.

This is yet another inefficiency on their part. When it comes to AC21 your file does not even get updated even though you may have attached I-485 receipt along with AC21 filing. But when the employer revokes I-140 they don't forget to send you NOID or even I-485 denial.

    From the Aytes memo:

    Question 1

How should service centers or district offices process unapproved I-140 petitions that were concurrently filed with I-485 applications that have been pending 180 days in relation to the I-140 portability provisions under 106(c) of AC21?

    Answer:

If it is discovered that a beneficiary has ported off of an unapproved I-140 and I-485 that has been pending for 180 days or more, the following procedures should be applied:

    A. Review the pending I-140 petition to determine if the preponderance of the evidence establishes that the case is approvable or would have been approvable had it been adjudicated within 180 days. If the petition is approvable but for an ability to pay issue or any other issue relating to a time after the filing of the petition, approve the petition on it’s merits. Then adjudicate the adjustment of status application to determine if the new position is the same or similar occupational classification for I-140 portability purposes.
    B. If a request for additional evidence (RFE) is necessary to resolve a material issue, other than post-filing issues such as ability to pay, an RFE can be issued to try to resolve the issue. When a response is received, and if the petition is approvable, follow the procedures in part A above.

Hope this clears stuff up. RFE's are generally issued for ability to pay issues. If all's clear on that front, there should simply be no issue

I agree, I wanted to take everybodys perspective on my guess. Also, 2004 is the only year which can be predictable, after that everything went haywire for EB2.
